Terms of Service

The terms and conditions listed herein, is a legal agreement between AZTERIK MEDIA GROUP, and any customer using Azterik.com product.

Using the product for any amount of time qualifies as an agreement. The customer will receive notice of any changes in terms and conditions. Notice may come in the form of e-mail, phone call, letter, and any other reliable form of communication. Acceptance to any changes may come in the form of 30 days of silence, immediately after notice is sent.

The terms “customer", means you, your Company, your Employees, and anyone who has right or wrongful access to YOUR Azterik software or products.

Any goods or service provided, created or sold by Azterik, qualifies as an Azterik Product” or “Products”.

Ownership, possession, or license to any Azterik product or products qualifies as “using” the product.

Each condition will dictate the use of the Azterik product, and if any condition is not met in the agreement between AZTERIK MEDIA GROUP and the customer, AZTERIK MEDIA GROUP has the express right to terminate the agreement. If a condition is not met, and AZTERIK MEDIA GROUP does not exercise its right to terminate, AZTERIK MEDIA GROUP still has the expressed right to terminate the agreement, if any future conditions are not met.

If in disagreement with any of the following terms or conditions, do not use the product. Once an Azterik product or products are in use that qualifies as an agreement.

Any rights not expressly granted herein are reserved by AZTERIK MEDIA GROUP.

Site License

A customer will have possession rights to one site license, after a sufficient deposit has been processed by any registered bank in the United States or Canada, in any AZTERIK MEDIA GROUP account. Sufficient deposit is any dollar amount over $300 US, or any currency equivalent to that. Possession rights may be terminated without notice, at any time.

A customer will have full legal right to one license to any Azterik product or products, once full payment on that particular product or products has been made.

A license will only be used accordingly to one web site at a time. You may switch web sites, but at no time be able to use any Azterik product or products simultaneously with one or more sites.

Disclaimer of Warranty for Azterik Products

Any Azterik Product or products are provided "as is" and without any warranties expressed or implied. In no event shall AZTERIK MEDIA GROUP, or its subsidiaries be liable for any damages whatsoever (including, without limitation, lost profits, business interruption or lost information) resulting from the use of or inability to use the software.

Errors on Our Website

Despite our efforts to ensure that the information on our website is accurate, complete and current, there may be instances when information about a Product contains inaccurate or incomplete data, including data about the Product's price or availability. We make no warranty or guarantee that the information on our website is error-free, complete, or current. We reserve the right to correct errors and/or update the content on our website at any time without notice. We also reserve the right to refuse or cancel any order containing any error or inaccuracy, including after the order has been submitted, whether or not the order has been confirmed and your credit card charged. If your order is canceled after your payment has been processed, we will issue a full refund to the original pay type.

Limitations and Exclusions

We reserve the right to change Product pricing, terms, specifications and warranties without notice. In addition, we may revise these terms of use at any time by updating the website. We reserve the right to limit the number of Products sold, including the right to prohibit sales to re-sellers. Prices do not include shipping, tax or insurance. We do not review or edit any portion of gift messages and disclaim all responsibility for their content. We disclaim all responsibility for the accuracy of any map or direction presented on our website.

You may not use any Azterik Products or product to rent, lease, and license, grant a security interest in, or otherwise transfer or sublicense your rights to any third party.

Damages

In no event shall AZTERIK MEDIA GROUP, its subsidiaries or affiliates, or their respective officers, directors, employees, representatives or agents be liable for special, incidental, consequential, punitive, indirect, or other special damages, including but not limited to, loss of data, use, or profits, however caused, whether for breach of contract, negligence, or otherwise, and whether or not we have been advised of the possibility of any such damages.

Payment Types We Accept Online

We accept the following forms of payment for your online purchases: MasterCard, Visa, e-check, cash, check, money order and Paypal. For your online purchases, you may purchase multiple products in a single order.

We do accept online-only or virtual credit cards as long as they are issued by one of the credit card companies listed above. However, due to the requirements of these companies, these cards can only be used for website orders that are shipped. We do not accept online-only or virtual cards as a form of payment on Express Pickup orders.

Online Statement

If the customer is financing any Azterik product or products, they agree that the Online Statement is the only statement that needs to be provided to them. AZTERIK MEDIA GROUP will use reasonable efforts to correct any technical failures within a reasonable time. Inability to view an online statement does not relieve any obligation on the customer’s part to make a required monthly payment or balance owing.

Late Charges

The amount due to AZTERIK MEDIA GROUP must be paid in full by the date such payment is requested by AZTERIK MEDIA GROUP. Monthly payment under a finance plan, qualifies as “must be paid in full”, and does not suggest in any way, shape or form the balance of the total amount due. Total payment is due on the date specified by the date requested by AZTERIK MEDIA GROUP.

You may carry forward a balance.

YOU agree to pay late charges that may be assessed by AZTERIK MEDIA GROUP on amounts due but not timely paid. The late charge will be no less than 1.5% per day. Increase in percentage does not require consent from the customer, and no notice is required.

AZTERIK MEDIA GROUP reserves the right to refer your billing account to a third party for collection in the event of default. You agree to pay all costs incurred in the enforcement of these Terms of Use and in collection of any delinquent amounts due, including reasonable attorneys' fees and costs.

At any time a payment is late, AZTERIK MEDIA GROUP reserves the express right to claim full possession of the particular product in question.

At any time a payment is late, AZTERIK MEDIA GROUP reserves the right to terminate the agreement in regards to the particular product in question. Accepting a prior late payment and not exercising this right, does not change AZTERIK MEDIA GROUP’ future right to terminate the agreement, if a future payment is late.

Current and Future Liability

The customer must agree to defend, indemnify and hold AZTERIK MEDIA GROUP and its suppliers harmless from and against any and all claims, losses, liability costs and expenses (including but not limited to attorneys' fees) arising from your violation of these Terms and Conditions, or any third-party's rights, (including, without limitation, infringement of any copyright, violation of any proprietary right and invasion of any privacy rights). These obligations will survive any termination of agreement between you the customer and AZTERIK MEDIA GROUP.

Sales Tax Policy

We do business throughout the United States and accordingly collect sales and use tax as required by applicable law. Your confirmation of your order total will reflect the applicable state and local sales tax, if any. The tax rate applied to your order will generally be the combined state and local rate for the address where your order was shipped, delivered or picked up. For any online purchase of a tax-exempt item during a sales tax holiday period, by completing the purchase, you certify that the item is being purchased for personal use only and you agree to assume liability for the applicable tax if the item is used for other than personal use.

Shipped Products

You may have your Product shipped or delivered to your home via one of our available shipping or home delivery options. We ship orders on normal business days, which are Monday through Friday excluding government holidays.

You assume all risk of loss for shipped Products. Order information such as billing or shipping address that is inaccurate or incomplete may result in delays. Products can not be shipped to incomplete addresses.

Returns Policy for any Azterik Product or Products

There is no restocking fee for defective product returned in exchange for the exact same product.

For any exchange or refund, we need the original receipt or a record of the purchase in our system, and the product must be in its original condition, such that no code has been altered by the customer or a foreign third party.

Charges for installation and delivery services are nonrefundable after the services have been performed.

For any Product received that is not the Product ordered, we will exchange the item at no additional cost upon verification. Proof of purchase (e.g. order confirmation, packing slip or record of purchase in our system) is required for all returns.

You may return any merchandise purchased online via mail provided that the return meets these guidelines.

Merchandise purchased online through Azterik.com, which meets the Refunds and Returns guidelines above, may be returned via mail to our authorized return center.

You will be responsible for all shipping and insurance charges for returns, unless otherwise indicated. If you choose not to insure your package, and we do not accept return of the Product, you will be responsible for any loss or damage. Upon our acceptance of the merchandise in like new condition in conformity with this policy, the purchase price will be credited to your credit card or a mail refund check will be issued for a purchase made with a gift card as the sole payment method. Allow 14 days (not including delivery time for mail refunds) from when we accept your returned Product for the processing of your credit. Additional charges may be assessed for Products returned with any missing items such as manuals and/or accessories. For Product that we verify to be defective, we will reimburse you for your original shipping expense on the Product that you return or exchange.

Governing Law

These terms are governed and construed by the laws of Ontario without regard to its conflict of law rules. You agree that if any part of these terms is found to be unenforceable, the remainder of these terms will remain in full force and effect.

Our press releases, announcements, and postings to this may site contain forward-looking statements that involve risk and uncertainties. They do not constitute an offer to sell or an obligation to buy any security.

Trademarks and Service Marks

Azterik is a registered trademark of AZTERIK MEDIA GROUP and is used with permission. All other trademarks are the property of their respective companies and are used with permission.

Failure to Comply with Agreement

Failure to comply with this agreement could result in termination of your license without refund.

Age requirements

You must be at least 18 years of age to enter into an agreement with AZTERIK MEDIA GROUP.

Modifications

No modifications are allowed on any Azterik Product or Products, without our consent. Our consent can be withdrew at any time there after. Our codes may not be copied and applied to other applications also, without our consent.

Restrictions

All Azterik product or products may not be used to promote hate, child pornography, pornography, and must be in compliance with Canadian and US Federal and Local laws.

RESTRICTION CLAUSE

Any customer information and content that is seen or handled by AZTERIK MEDIA GROUP and its employees will remain private and confidential, and in no way, shape or form will be released into the hands of a third party. Our company is restricted from using any customer information and material that we may discover upon rendering services. We have signed restriction clauses in the past, and we will be more than willing to do so in the future, after careful review by our legal team and all conditions are deemed reasonable.
